These Terms & Conditions (“Terms”) govern your access to and use of garagedoordeals.ca (the “Website”) and the services offered through it (the “Service”), operated by Garage Door Deals (“Garage Door Deals,” “we,” “us,” or “our”). By accessing the Website or submitting a request, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, do not use the Website.

1. What the Service is

Garage Door Deals is a lead-generation and matching service. We collect the information you submit and forward it to one or more independent, third-party garage door companies (“Service Providers”) so that they may contact you regarding garage door repair, installation, spring replacement, or related services.

We are not a garage door company, and we are not part of the process. We do not provide, perform, manage, inspect, supervise, schedule, price, warrant, or take any part in any garage door work, or in any communication, negotiation, agreement, quote, payment, or dispute between you and a Service Provider. We do not act as your agent, broker, contractor, or representative, nor as the agent or representative of any Service Provider. The Service is limited to passing along the information you choose to submit.

2. No guarantees; no professional advice

We do not guarantee that you will be matched with or contacted by any Service Provider, that you will receive any quote or estimate, that you will receive a specific number of quotes, or that any pricing, availability, timing, or outcome will be achieved. References to “up to 5” quotes describe a maximum and are not a promise. Information on the Website is provided for general informational purposes only and does not constitute professional, legal, financial, or safety advice.

3. Relationship with Service Providers

Service Providers are independent third parties. They are not employees, agents, partners, joint venturers, or representatives of Garage Door Deals, and we do not control, direct, or supervise them. We do not screen, endorse, recommend, guarantee, or warrant any Service Provider or their licensing, insurance, qualifications, conduct, workmanship, pricing, or results. Any agreement, transaction, payment, dispute, or relationship between you and a Service Provider is solely between you and that Service Provider.

4. Your responsibilities

By using the Service, you agree that you will:

provide accurate, current, and complete information;
be at least the age of majority in your province of residence;
independently verify each Service Provider’s licensing, insurance, references, reviews, and the terms of any estimate or contract before hiring them;
use the Website only for lawful purposes and not submit requests on behalf of others without their permission; and
not misuse, disrupt, scrape, or attempt to gain unauthorized access to the Website.

5. Consent to be contacted

By submitting your information, you consent to be contacted by Garage Door Deals and by the Service Providers we match you with by telephone, email, and/or text message at the contact details you provide, consistent with our Privacy Policy and Canada’s Anti-Spam Legislation. You may withdraw consent as described in the Privacy Policy.

6. Disclaimer of warranties

The Website and Service are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.

7. Assumption of risk, release, and limitation of liability

You use the Website and engage any Service Provider entirely at your own risk. You acknowledge that Garage Door Deals takes no part in, and has no control over, the conduct of Service Providers or the work they perform, and you assume all risk arising from your dealings with them.

To the fullest extent permitted by applicable law, Garage Door Deals and its owners, officers, directors, employees, contractors, and agents (the “Released Parties”) accept no liability whatsoever — whether in contract, tort, negligence, strict liability, statute, or otherwise — for any loss, damage, injury, death, cost, or expense of any kind, whether direct, indirect, incidental, special, consequential, punitive, or exemplary (including loss of profits, data, goodwill, property damage, and personal injury), arising out of or related to: (a) your access to or use of, or inability to use, the Website or Service; (b) any act, omission, communication, negotiation, agreement, quote, payment, transaction, or dispute involving a Service Provider; (c) any work performed or not performed by a Service Provider; or (d) the conduct, licensing, insurance, or qualifications of any Service Provider — even if a Released Party has been advised of the possibility of such loss or damage.

Release and waiver. You irrevocably release, waive, and discharge the Released Parties from any and all claims, demands, actions, and liabilities of every kind, known or unknown, that you now have or may have in the future arising out of or related to the Service or any Service Provider, and you agree not to bring any claim against the Released Parties in connection with them.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. To the maximum extent permitted by law, and only to the extent some liability cannot be fully excluded, the total aggregate liability of the Released Parties for any and all claims arising out of or related to the Website or Service will not exceed CAD $100.

8. Indemnification

You agree to indemnify, defend, and hold harmless Garage Door Deals and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Website or Service, your breach of these Terms, or your dealings with any Service Provider.

9. Intellectual property

The Website and its content, including text, graphics, logos, and design, are owned by or licensed to Garage Door Deals and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Website without our prior written permission.

10. Third-party links and content

The Website may contain links to third-party websites and resources. We are not responsible for the availability, accuracy, content, or practices of those third parties, and links do not imply endorsement.

11. Changes to the Service and Terms

We may modify or discontinue the Website or Service, and we may update these Terms, at any time. The “Last updated” date above reflects the most recent version. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute that is not otherwise subject to binding resolution.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
